2. Client Responsibilities

To ensure smooth collaboration, clients are responsible for:

  1. Providing accurate, complete, and timely information necessary for project execution.
  2. Responding promptly to requests for approvals, feedback, or additional details.
  3. Ensuring compliance with all applicable laws and regulations related to their business.
  4. Notifying us of any changes in requirements, preferences, or objectives that may impact the project.

Failure to meet these obligations may result in project delays or additional charges.

3. Payment Terms

  • Advance Payment: A 50% advance is mandatory before initiating any project.
  • Remaining Payment: The balance 50% is to be paid upon project completion or as per pre-agreed milestones.
  • Payment Deadlines: All payments must be made within the deadlines mentioned in the invoice.
  • Late Payments: Late payments may attract additional charges or result in suspension of services.

Payment modes include bank transfers, UPI, credit/debit cards, or any method agreed upon during the engagement.

4. Refund and Cancellation Policy

  • No Refund Policy: All payments made are final and non-refundable.
  • Cancellations: Clients may cancel their projects at any time; however, no refunds will be provided for any payments already made.

We encourage clients to thoroughly review proposals and project plans before making payments.

5. Data Privacy and Confidentiality

Katariya Global values client privacy and strictly adheres to data protection regulations as per the Indian Constitution and global standards where applicable.

  1. Data Collection and Use: Any information shared by the client will only be used for project-related purposes.
  2. Confidentiality: All client data, credentials, and project details will remain confidential and will not be shared with any third party without explicit consent, except where required by law.
  3. Data Security: We implement industry-standard practices to protect client data from unauthorized access or breaches.

6. Ownership and Intellectual Property Rights

  • Ownership of Deliverables: All materials created by Katariya Global (content, designs, campaigns) will remain our property until full payment is received. Upon full payment, ownership is transferred to the client.
  • Portfolio Use: We reserve the right to showcase completed projects in our portfolio or marketing materials unless the client explicitly prohibits this in writing.
  • Copyrights: Clients must ensure that any materials they provide do not infringe on third-party copyrights or trademarks.

7. Limitation of Liability

Katariya Global shall not be held liable for:

  • Any indirect, incidental, or consequential damages arising from the use of our services.
  • Delays or errors caused by client-provided information or third-party platforms (e.g., social media, search engines).
  • Losses resulting from changes in algorithms, market conditions, or external factors beyond our control.

Our liability is strictly limited to the amount paid by the client for the specific service in question.

8. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of India.

Any disputes arising from these terms or our services will be subject to the jurisdiction of the courts in India.

9. Force Majeure

Katariya Global will not be held responsible for delays or failure to perform obligations due to unforeseen events beyond our control, including but not limited to:

  • Natural disasters (e.g., floods, earthquakes).
  • Government actions or changes in regulations.
  • Pandemics or public health emergencies.
  • Technical disruptions or cyberattacks.

In such cases, we will make reasonable efforts to minimize delays and fulfill our obligations.

10. Termination of Services

We reserve the right to terminate services under the following circumstances:

  • Non-payment of dues by the client.
  • Violation of these Terms and Conditions.
  • Any behavior or action that disrupts the working relationship.

Termination will be communicated in writing, and no refunds will be provided for work already completed.

11. Amendments to Terms

Katariya Global reserves the right to amend these Terms and Conditions at any time. Updated terms will be made available on our website. Continued use of our services constitutes acceptance of the revised terms.

All official communication will be conducted via email or WhatsApp.
